وضعت حكومة المملكة العربية السعودية «حج بلا تصريح» في سياقه الصحيح لهذا العام، بهدف توفير الأمن والسلامة والطمأنينة للحجاج من خلال ضبط المخالفين في الحملات الوهمية ومنع نقل الحجاج غير النظاميين أو المتخلفين والهاربين والمتسللين إلى المشاعر، في إجراء سليم يضمن أداء الحجاج مناسكهم براحة ويسر وأمن وأمان دون مخاطر كما كان يحصل في السابق، محذرة كل من تسول له نفسه مخالفة الأوامر، فارضة الغرامات والعقوبات على ضعاف النفوس وتجار الحج.
ما قامت به الدولة هذا العام له أساس في دين الله، فهناك آية صريحة في كتاب الله بجواز متعة الحج، حتى كان زمن عمر بن الخطاب فنهى عنها بقصد التنظيم، لمّا رأى الناس مالوا إلى التمتع لسهولته، فخشي أن يضيع الإفراد والقِران، ولمصلحة أهالي مكة المكرمة أيضاً ولعمارة البيت الحرام طوال العام بالزوار والمعتمرين.
وهنا يبرز دور الحاكم في تقييد المباح من أجل المصلحة العامة، وقد فعلها سيدنا عمر في أكثر من موقف متوخياً المصلحة العامة ومقاصد الشريعة، لصالح الأمة رغم الآيات البينات والسنن الواضحة.
فلولي الأمر أن ينظم أمور رعيته وأن يتدخل فيها ويفرض القوانين ويسن التعليمات، ولعل من ضمنها حقه المطلق في تحديد عدد الحجاج لأداء الفريضة ويقرر (بألا حج دون تصريح)، ويمنع الناس من تكرار الحج في كل عام، وأن يحافظ على حياتهم بمنعهم في زمن معين على عدم إتيان المباحات، إذا رأى في ذلك مصلحة معتبرة.
فله حق الاجتهاد في التعرف على المصلحة، والمجتهد دائر بين الأجر والأجرين.
وقد رأينا في هذا العام تشدد الحاكم حفظه الله في مراعاة مصالح الحجيج والحفاظ على أرواحهم وممتلكاتهم، فواءم بين الواقع والواجب، مستهدفاً المصلحة العامة لكل قادم ومقيم ومواطن دون الخروج عن النصوص أو الأحكام المُجمع عليها، في عملية تنظيمية محكمة للحج، مراعاة لظروف المكان الجغرافي، وحتى يتمتع الحجاج بما قامت به الدولة من جهود جبارة في عمارة المسجد الحرام ومشاريع المشاعر والتفويج للمدينة المنورة وتسهيل أمورهم في الطواف والسعى ورمي الجمرات وذبح الهدي وحتى عودتهم إلى أوطانهم سالمين. مجموعة مشاريع حديثة من قطارات ومسارات وأنفاق وخدمات صحية وتخصيصية، فالمصلحة لها ارتباط وثيق بحقوق الإنسان وحرّياته، وهي موجودة في كل تشريع وبالأخص في الدين الإسلامي الذي تقوم فيه المصلحة العامة أو المُرسلة وتغليبها، بجلب منفعة ودفع مضرة، والمحافظة على مقصود الشرع بالمحافظة على الدين والعرض والمال والعقل والنفس.
وهذا ما سعت إليه الدولة هذا العام لضبط أمور الحجاج وتسهيل الأمر عليهم ومنع الافتراش والفوضى والتزاحم والتدافع والتساقط الذي كان يحدث في السابق ويعرض الحجيج إلى الموت والهلاك.
نتيجة هذا التنظيم الموفق والترتيب المُحكم كان حج هذا العام حجاً نموذجيا حتى اللحظة، مضى بكل يسر وسهولة، وفي أمن وأمان وسلاسة بعيداً عن فوضى الأعوام السابقة، اختفت الحوادث المميتة وحل محلها الشعور بالأمن والطمأنينة.
إن مقاصد الشريعة هي تحقيق مصالح الناس في الدنيا والآخرة وفي العاجل والآجل، وأن أحكام الله قائمة على رعاية المصالح، وأنه سبحانه شرع الأحكام لمقاصد،
فما فعله ولي الأمر في حج هذا العام هو لصالح المسلمين حفاظاً على أرواحهم
بعيداً عّن الغوغائيين وسفهاء المواقع وعديمي الأخلاق ومن في قلوبهم مرض.

The government of the Kingdom of Saudi Arabia has put "Hajj without a permit" in its correct context this year, aiming to provide security, safety, and reassurance to pilgrims by controlling violators of fake campaigns and preventing the transport of irregular, stranded, runaway, and infiltrating pilgrims to the sacred sites. This is a sound measure that ensures pilgrims can perform their rituals comfortably, easily, and safely without the risks that occurred in the past, warning anyone who might think of violating the orders, imposing fines and penalties on the weak-hearted and Hajj traders.
What the state has done this year is based on the religion of God, as there is a clear verse in the Book of God permitting the enjoyment of Hajj. During the time of Umar ibn al-Khattab, he prohibited it for the sake of organization when he saw that people were inclined towards it due to its ease, fearing that the individual and combined Hajj would be neglected, and for the benefit of the people of Makkah as well, to keep the Sacred House populated with visitors and pilgrims throughout the year.
Here, the role of the ruler emerges in restricting what is permissible for the public good, as our master Umar did in more than one instance, seeking the public interest and the objectives of Sharia for the benefit of the nation, despite the clear verses and established traditions.
It is the duty of the ruler to organize the affairs of his subjects, to intervene and impose laws and issue instructions, and among these is his absolute right to determine the number of pilgrims for performing the obligatory Hajj and to decide (that there is no Hajj without a permit), preventing people from repeating Hajj every year, and to protect their lives by prohibiting them from engaging in permissible acts during certain times if he sees a considerable interest in that.
He has the right to exercise independent judgment in identifying the interest, and the one who exercises independent judgment is rewarded or rewarded twice.
This year, we have seen the ruler, may God preserve him, being strict in considering the interests of the pilgrims and preserving their lives and property, balancing reality and duty, targeting the public interest for every visitor, resident, and citizen without deviating from the texts or the agreed-upon rulings, in a well-organized process for Hajj, taking into account the geographical conditions, so that pilgrims can enjoy the tremendous efforts made by the state in the construction of the Sacred Mosque, projects for the sacred sites, and the organization of the city of Medina, facilitating their affairs in Tawaf, Sa’i, throwing stones, and slaughtering the sacrificial animals, and even their safe return to their homelands. A series of modern projects including trains, paths, tunnels, health services, and specializations, as the public interest is closely linked to human rights and freedoms, and it exists in every legislation, especially in Islamic law, which prioritizes public interest or the general welfare, bringing benefit and preventing harm, and preserving the objectives of Sharia by protecting religion, honor, wealth, intellect, and life.
This is what the state has sought to achieve this year to regulate the affairs of the pilgrims, facilitate matters for them, and prevent the overcrowding, chaos, pushing, and falling that used to occur in the past, exposing the pilgrims to death and destruction.
The result of this successful organization and meticulous arrangement has made this year's Hajj a model Hajj so far, proceeding with ease and safety, away from the chaos of previous years, with deadly incidents disappearing and replaced by a sense of security and reassurance.
The objectives of Sharia are to achieve the interests of people in this world and the Hereafter, both in the immediate and the delayed, and that God's rulings are based on caring for interests, and that He, the Exalted, has legislated rulings for purposes.
What the ruler has done this year in Hajj is for the benefit of Muslims, preserving their lives
away from the rabble-rousers, the fools of the platforms, the immoral, and those with sickness in their hearts.
