أدرجت وزارة الثقافة «قائمة المنع» ضمن لائحة تراخيص هيئة المكتبات، وذلك استنادًا إلى المادة الثامنة عشرة من اللائحة الصادرة بقرار وزير الثقافة رقم (1750/ق) بتاريخ 9 ربيع الأول 1447هـ، والمتضمنة ثلاثةً وعشرين مادة تنظم إجراءات منح التراخيص الثقافية وآليات الرقابة والإشراف عليها.
ونصت المادة على أن للهيئة - عند عدم التزام المرخص له بأحكام اللائحة أو قواعد التراخيص - اتخاذ أحد الإجراءات الآتية: الإنذار، أو تعليق الترخيص إلى حين تصحيح المخالفة، أو إلغاؤه. كما خوّلتها إدراج المخالف ضمن قائمة المنع لمدة لا تتجاوز 3 سنوات عند تكرار المخالفة خلال فترة 6 أشهر من تاريخ إيقاع أي إجراء سابق بحقه.
وجاء إدراج «قائمة المنع» ضمن القسم الرابع من اللائحة الخاص بحالات عدم الالتزام بأحكام اللائحة أو قواعد التراخيص، كإجراء تنظيمي يهدف إلى ضبط الممارسات الثقافية وضمان الامتثال المهني للنشاطات المرخصة.
وتشمل اللائحة 5 أقسام رئيسة تغطي الأحكام العامة، والتراخيص، والرقابة والإشراف، وحالات عدم الالتزام، والأحكام الختامية، ويبدأ العمل بها بعد تسعين يومًا من تاريخ نشرها في الجريدة الرسمية.
The Ministry of Culture has included a "prohibition list" in the licensing regulations of the Libraries Authority, based on Article 18 of the regulations issued by the Minister of Culture's decision No. (1750/Q) dated 9 Rabi' al-Awwal 1447 AH, which includes twenty-three articles that regulate the procedures for granting cultural licenses and the mechanisms for oversight and supervision.
The article states that the authority, in the event of non-compliance by the licensee with the provisions of the regulations or licensing rules, may take one of the following actions: issuing a warning, suspending the license until the violation is corrected, or revoking it. It also authorizes the inclusion of the violator in the prohibition list for a period not exceeding 3 years if the violation is repeated within 6 months from the date of any previous action taken against them.
The inclusion of the "prohibition list" in the fourth section of the regulations, which pertains to cases of non-compliance with the provisions of the regulations or licensing rules, is an organizational measure aimed at regulating cultural practices and ensuring professional compliance with licensed activities.
The regulations include 5 main sections covering general provisions, licensing, oversight and supervision, cases of non-compliance, and final provisions, and they will come into effect ninety days after their publication in the official gazette.
