رفع الفنان الليتواني المقيم في ماليزيا إرنست زاخاريفيتش دعوى قضائية ضد شركة الطيران منخفضة التكلفة AirAsia، وشركتها الأم Capital A Berhad، متهمًا إياهما باستخدام أحد أشهر أعماله الفنية على إحدى طائراتهما دون الحصول على موافقته.
وبحسب الدعوى، فإن لوحة الشارع الشهيرة «Kids on Bicycle»، التي رسمها زاخاريفيتش عام 2012 في منطقة جورج تاون التراثية بولاية بينانغ، جرى «استنساخها وعرضها» ضمن تصميم خارجي (livery) على طائرة تابعة للشركة أواخر عام 2024.
وأكد الفنان أن استخدام العمل تم «من دون موافقة أو ترخيص»، مشيرًا إلى أن التصميم أُزيل لاحقًا بعد أن أثار المسألة علنًا عبر وسائل التواصل الاجتماعي.
وتُعد لوحة «Kids on Bicycle» واحدة من أبرز المعالم الفنية في جورج تاون، حيث تُظهر طفلين يضحكان على دراجة حقيقية مثبتة في الجدار، ما يجعلها نقطة جذب سياحية بارزة يلتقط عندها الزوار الصور باستمرار.
وقال زاخاريفيتش إنه شاهد الطائرة بنفسه في أحد المطارات، واصفًا الموقف بأنه «شعر بقليل من الإهانة»، مؤكدًا أن العمل «إبداع فني مستقل وليس مجرد رمز ثقافي عام».
وكشفت وثائق الدعوى أن الفنان كان قد أجرى محادثات مع الشركة في عام 2017 بشأن إمكانية تنفيذ أعمال فنية لطائراتها ومكاتبها، ما يعني (بحسب ادعائه) أن الشركة كانت على دراية كاملة بطبيعة أعماله وشروطه المهنية.
ورغم إجراء محادثات لاحقة بين الطرفين لم يتم التوصل إلى تسوية حتى الآن، بينما ترك الفنان للمحكمة تحديد قيمة التعويض المحتمل.
وتأتي القضية في وقت أعلنت فيه «AirAsia»، أكبر شركة طيران اقتصادي في آسيا، خططًا لاستئناف رحلاتها من كوالالمبور إلى لندن عبر البحرين، في عودة إلى العاصمة البريطانية بعد أكثر من عقد.
ولم تصدر الشركة تعليقًا رسميًا حتى الآن بشأن الدعوى.
The Lithuanian artist residing in Malaysia, Ernest Zacharevich, has filed a lawsuit against the low-cost airline AirAsia and its parent company Capital A Berhad, accusing them of using one of his most famous artworks on one of their planes without obtaining his consent.
According to the lawsuit, the famous street painting "Kids on Bicycle," which Zacharevich created in 2012 in the heritage area of George Town in Penang, was "replicated and displayed" as part of an exterior design (livery) on one of the company's aircraft in late 2024.
The artist confirmed that the use of the work was "without permission or license," noting that the design was later removed after he publicly raised the issue via social media.
The painting "Kids on Bicycle" is considered one of the most prominent artistic landmarks in George Town, depicting two laughing children on a real bicycle mounted on the wall, making it a major tourist attraction where visitors continuously take photos.
Zacharevich stated that he saw the plane himself at an airport, describing the situation as "a bit insulting," emphasizing that the work is "an independent artistic creation and not just a general cultural symbol."
Documents from the lawsuit revealed that the artist had discussions with the company in 2017 regarding the possibility of creating artworks for its planes and offices, which means (according to his claim) that the company was fully aware of the nature of his works and his professional terms.
Despite subsequent discussions between the two parties, no settlement has been reached so far, while the artist has left it to the court to determine the potential compensation value.
The case comes at a time when "AirAsia," the largest low-cost airline in Asia, announced plans to resume flights from Kuala Lumpur to London via Bahrain, marking a return to the British capital after more than a decade.
The company has not yet issued an official comment regarding the lawsuit.
