تواصل إدارة الرئيس الأمريكي دونالد ترمب التحضير لخيارات بديلة تحسّباً لاحتمال أن تقرر المحكمة العليا تقييد أو إلغاء سلطاته في فرض الرسوم الجمركية.
وبحسب مسؤولين أمريكيين مطّلعين على سير المناقشات، فقد عملت وزارة التجارة ومكتب الممثل التجاري الأمريكي على إعداد «خطة بديلة» في حال أصدرت المحكمة حكماً ضد الإدارة.
وتشمل الخيارات قيد الدراسة اللجوء إلى المادتين 301 و122 من قانون التجارة، اللتين تمنحان الرئيس صلاحيات أحادية لفرض الرسوم، وفقاً لوكالة «بلومبيرغ».
غير أن هذه البدائل تواجه تحديات متعددة، إذ تعتبر أبطأ أو أقل شمولاً من الصلاحيات الواسعة التي استخدمها ترمب حتى الآن، كما أنها قد تكون عرضة أيضاً لطعون قانونية، ورغم ذلك، لا تزال الإدارة تأمل في صدور قرار لصالحها.
وكان ترمب قد دعا مراراً قضاة المحكمة العليا للإبقاء على الرسوم التي فرضها بموجب ما وصفه بـ«حالة الطوارئ الاقتصادية».
وكتب الرئيس الأمريكي في وقت سابق على منصة «تروث سوشيال»: «تلقت المحكمة العليا بيانات غير دقيقة. وإذا حكمت ضد الرسوم الجمركية، فإن الإلغاء وما يستتبعه من تعويضات واسترجاع للاستثمارات القائمة والمخطط لها سيتجاوز 3 تريليونات دولار».
The administration of President Donald Trump continues to prepare alternative options in anticipation of the possibility that the Supreme Court may decide to restrict or overturn his powers to impose tariffs.
According to American officials familiar with the discussions, the Department of Commerce and the Office of the U.S. Trade Representative have been working on preparing an "alternative plan" in case the court rules against the administration.
The options under consideration include resorting to Sections 301 and 122 of the Trade Act, which grant the president unilateral powers to impose tariffs, according to Bloomberg.
However, these alternatives face multiple challenges, as they are considered slower or less comprehensive than the broad powers Trump has used so far, and they may also be subject to legal challenges. Nevertheless, the administration still hopes for a favorable ruling.
Trump has repeatedly urged Supreme Court justices to uphold the tariffs he imposed under what he described as an "economic emergency."
The U.S. president previously wrote on the Truth Social platform: "The Supreme Court received inaccurate data. If it rules against the tariffs, the cancellation and the resulting compensations and refunds for existing and planned investments will exceed $3 trillion."
