يعتزم الشاعر الغنائي المصري فوزي إبراهيم، مقاضاة الفنانة اللبنانية نانسي عجرم لحماية حقوقه بعدما أقدمت على بيع أغنيتها «أخاصمك آه» لإحدى الشركات.
وعبر إبراهيم عن استيائه من خلال منشور عبر صفحته على فيسبوك كتب فيه «مين يصدق إن الست نانسي عجرم في مفاجأة صادمة باعت حقوق هذه الأغنية «أخاصمك آه» وأغاني أخرى لشركة ديجيتال، مدعية ملكيتها لكل الحقوق بما فيها حق المؤلف العبدالله وحق الملحن محمد سعد الذي مات شاباً بسرطان الدم وترك ابناً يتيماً».
وأضاف: «استباحت نانسي عجرم وشركة الديجيتال حقوق ابن محمد سعد عن كل ما قدمه أبوه لها من ألحان صنعت شهرتها؟!، ولم تترك لنا أمام هذه الصدمة سوى أن نقاضي هذه الشركة ونقاضيها في القريب العاجل أنا وابن المرحوم محمد سعد».
علماً أنه يحق لأي مطرب بيع الأغنية التي اشتراها من الكاتب والملحن إذا كان قد حصل على حقوق الملكية الفكرية الخاصة بها، سواء كانت حقوق النشر والتوزيع أو حقوق الأداء. يعتمد الأمر على نوعية العقد الذي أبرمه المطرب مع الملحن أو الشاعر أو الشركة المنتجة، وما إذا كان العقد يتضمن حق إعادة البيع أو التنازل عن الحقوق.
وأصدرت النجمة اللبنانية أغنية «أخاصمك آه» عام 2003، وحققت حينها من خلال الفيديو كليب المرح والعفوي نجاحاً كبيراً وشهرة واسعة في الوطن العربي.
The Egyptian lyricist Fawzy Ibrahim intends to sue the Lebanese artist Nancy Ajram to protect his rights after she sold her song "Akhaseemak Ah" to a company.
Ibrahim expressed his dissatisfaction through a post on his Facebook page, writing, "Who would believe that Nancy Ajram shockingly sold the rights to this song 'Akhaseemak Ah' and other songs to a digital company, claiming ownership of all rights including the rights of the author Abdullah and the rights of the composer Mohamed Saad, who died young from leukemia and left behind an orphaned son."
He added, "Nancy Ajram and the digital company have violated the rights of Mohamed Saad's son for everything his father provided her in terms of melodies that made her famous?! We have no choice but to sue this company and take legal action soon, me and the son of the late Mohamed Saad."
It is worth noting that any singer has the right to sell the song they purchased from the writer and composer if they have obtained the intellectual property rights for it, whether it be publishing and distribution rights or performance rights. It depends on the type of contract the singer has with the composer or lyricist or production company, and whether the contract includes the right of resale or the waiver of rights.
Nancy Ajram released the song "Akhaseemak Ah" in 2003, and it achieved great success and wide fame in the Arab world through its fun and spontaneous music video.
